Illegal dumping is disposal of waste in an unpermitted area, usually in an open area, from vehicles along roadsides and late at night. Materials typically include construction and demolition waste, abandoned automobiles, auto parts and scrap tires, appliances, furniture, yard waste and household trash.

 

Sites used for illegal dumping vary but may include abandoned industrial, residential, or commercial buildings, vacant lots on public or private property and infrequently used alleys or roadways. Because of their accessibility and poor lighting, areas along rural roads and railways are particularly vulnerable. If not addressed, illegal dumps often attract more waste, potentially including hazardous wastes such as asbestos, household chemicals and paints, automotive fluids and commercial or industrial wastes.

 

Who is your typical illegal dumper? There is no one profile, but offenders have included construction, demolition, remodeling, roofing, and landscaping contractors; waste management companies and general hauling contractors; automobile repair and tire shops; scrap collectors; residents and “do it yourselfers”.

Health Risks

  • Drinking water quality issues related to non-point source pollution (especially in areas with private wells)
  • Flooding caused by debris/wastes that clog drainage ditches and waterways
  • Habitat/breeding grounds for disease-carrying vectors
  • Indirect exposure to toxic chemicals/hazardous wastes
  • Inhaling pollutants carried by smoke from open burning (“burn barrels”, etc.) and dump fires
  • Direct contact exposure to sharp objects, medical wastes, caustic substances, and fire (especially a risk for children playing in the area)

4 STEPS TO STOP ILLEGAL DUMPING IN EUCLID

  1. Call the Police & Housing with all the pertinent information you can collect at 216-289-1234.
  2. Have available the address of the location where the trash is or dumping is occurring.
  3. Be able to assess what type of trash or substance is on the property.
  4. Be prepared to give your name and phone number in case property cannot be located.

 

 

THE PROCESS

  • A City inspector will go out to confirm the exact location of the property and assess what is there.
  • The Housing Department will notify the property owner and hold them accountable for the clean-up.
  • The property owner will be given a total of 48 hours to bring the property into compliance, or further enforcement actions will be taken. The owner will be billed and/or a lien may be placed on the property for clean up of the debris.

Abandoned Cars

Defining abandoned vehicles

  • A vehicle is generally considered abandoned if it is left on a public street or property for 48 hours or longer without notification to police
  • Some municipalities within Cuyahoga County may have slightly different definitions or additional criteria for vehicles considered abandoned on private property.


Removing abandoned vehicles

  • Once reported and confirmed as abandoned, law enforcement may initiate the process of having the vehicle removed and impounded.
  • Owners may be able to reclaim their vehicles from impoundment by paying expenses and charges incurred during removal and storage, along with proof of ownership. 


Important notes

  • If the abandoned vehicle is on private property, you should still report it to the authorities. They may issue a notice to the property owner for removal.
  • Leaving an abandoned junk motor vehicle on private property for more than 72 hours without the owner's permission is also a violation.
  • The definition of an "abandoned junk motor vehicle" in Ohio law involves several criteria, including being three years old or older, extensively damaged, apparently inoperable, and having a fair market value of $1,500 or less, according to the Ohio Revised Code.

Dille Road Recycling: Situated at 1423 Dille Rd, Euclid, OH 44117, they accept a variety of scrap metals. They are open Monday-Wednesday and Friday from 8 AM to 4:30 PM, and Thursday from 8 AM to 4:30 PM.

 

A few other laws to keep in mind while we Keep Euclid Beautiful and shine light on illegal dumping:

 

1113.17 DUMPING.

   (a)   No person shall throw or deposit or permit to be thrown or deposited any dirt, paper, filth, sweepings, ashes, shavings, filthy water, offal, straw, wood, stones, earth, manure, refuse matter or rubbish of any kind whatsoever, into any public street, lane, alley or public property.

   (b)   The depositing and dumping of fill dirt, topsoil, ashes, straw, manure and any other substance conducive to the growth of vegetation shall be permitted upon private property with the consent of the owner of such property and with permission of the Service Director.

   (c)   Any person violating the provisions of this section shall forthwith remove the same on order of the Director.

1129.01 LITTERING.

   (a)   Definition. “Litter” means any garbage, waste or peelings of vegetables or fruits, rubbish, ashes, cans, bottles, wire, paper, cartons, boxes, automobile parts, tires, construction debris, furniture, glass, oil or any object or substance which tends to create a danger to public health, safety, or welfare or which by sight or smell creates or contributes to unsightly or unsanitary conditions.

   (b)   Litter in Public Places. No person, firm or corporation shall throw, place or dispose of in any manner any litter near or on any public road, street, parkway, park drive, highway, ditch or any land adjoining any public road, highway or ditch, except on land provided by the Planning and Zoning Commission, City ordinance or other governmental authority, unless directed to do so by public officials on special cleanup days.

   Upon application, the Public Service Director may issue a permit, subject to such terms and conditions as he or she may determine, for the disposal of earth, clean ashes or other material not deemed a nuisance.

   (c)   Litter on Private Property. No person shall throw or deposit litter on any open, vacant, or occupied private property within the City whether owned by such person or not.

   (d)   Owner to Maintain Premises Free of Litter. The owner or person in control of any private property shall maintain the premises free of litter. This section shall not prohibit the storage of litter in authorized private receptacles for collection in such a manner that litter will be prevented from being carried or deposited by the elements upon any street, sidewalk, or other public place or upon any private property.

   (e)   Merchants' Duty to Keep Sidewalks Free of Litter. No person owning or occupying a place of business shall sweep into or deposit in any gutter, street or other public place within the City the accumulation of litter from any building or lot or from any public or private sidewalk or driveway. Persons owning or occupying places of business within the City shall keep the sidewalk in front of their business premises free of litter.

   (f)   Merchants' Duty to Maintain Waste Disposal Area. It shall be unlawful for any commercial property owner or occupier to permit open or overflowing waste disposal containers, dumpsters or bins on the property. Waste shall be deposited and controlled so as not to be scattered by the winds and the area surrounding waste disposal containers of any kind shall be maintained free of waste at all times.

   (g)   Posting Notices Prohibited. No person shall place, post or affix any notice, poster, or other paper or device, calculated to attract the attention of the public in the public right-of-way, or on any public property, or to any lamppost, public utility pole, or shade tree in the public right-of-way or on public property, or upon any public structure or building, except as authorized or required by law.

   (h)   Littering from Motor Vehicles.

      (1)   No operator or occupant of a motor vehicle shall, regardless of intent, throw, drop, discard, or deposit litter from any motor vehicle in operation upon any street, road, or highway, except into a litter receptacle in a manner that prevents its being carried away or deposited by the elements.

      (2)   No operator of a motor vehicle in operation upon any street, road, or highway shall allow litter to be thrown, dropped, discarded, or deposited from the motor vehicle, except into a litter receptacle in a manner that prevents its being carried away or deposited by the elements.

   (i)   Parental Responsibility. No person, including a parent, guardian, or other custodian of a child, shall allow a child under the care and control of the parent, guardian, or other custodian, to violate any provision of this ordinance. It shall be an affirmative defense to a violation of this provision that the parent, guardian, or other custodian of the child has invoked the jurisdiction of the Juvenile Court against the child prior to the time the child was found to be violating any provision of this ordinance.

   (j)   Enforcement. All sections of this ordinance may be enforced by any Euclid Police Officer. All sections, with the exception of sections (h) and (i), may be enforced by any Euclid Building or Housing Inspector.

   (k)   Penalty. Whoever violates any provision of this ordinance is guilty of littering, a misdemeanor of the fourth degree and shall be fined seventy-five dollars ($75.00) for each violation of this section. Whoever fails to pay said fine within 14 days shall be bound over to the Euclid Municipal Court and subject to prosecution and penally of not more than two hundred fifty dollars ($250.00) or imprisoned not more than 30 days, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

1113.18 WEEDS; NOTICE.

   (a)   Every person, firm or corporation having possession, charge or management of any occupied or unoccupied area shall maintain the area in a sanitary manner and shall preserve the health and further the welfare of the residents of the City by cutting and destroying, or causing to be cut or destroyed, all noxious weeds, plants or other growths, and further by removing all accumulations of garbage, fallen tree branches, cans or other debris upon such occupied or unoccupied area.

   (b)   The Service Director is hereby authorized to give notice in writing to the person, firm or corporation having possession or control of any occupied or unoccupied land to cut and destroy, or cause to be cut or destroyed, all noxious weeds, plants or other growths, and further, to remove all accumulations of garbage, fallen tree branches, cans or other debris thereon. Upon failure to comply with such notice within forty-eight hours, the weeds or other growths shall be cut or destroyed by the City or its agent, or the garbage, fallen tree branches, cans or other debris shall be removed by the City or its agent, and the cost thereof, including any direct administrative costs, charged to the owner of such land at a standard rate which shall be just and equitable and which shall be determined by the Service Director. On failure of the owner to pay the cost within thirty days after billing, the cost may be assessed against the land or a civil suit may be instituted at the discretion of the Director of Law. Such assessment or civil suit shall be in addition to the penalty provided in Section 1101.99.

Whoever violates or fails to comply with any of the provisions of this Part Eleven - Health and Sanitation Code, for which no penalty is otherwise provided, is guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.

The owners of abutting lots and lands shall keep the sidewalks, curbing, gutters and tree lawns in repair, free from any nuisance, in good order and properly maintained.

903.09 CLEANING SIDEWALKS.

   Whenever the Service Director finds that a sidewalk should be cleaned so as to be free from any objectionable substance, he or she shall order such sidewalk cleaned and notice shall be served upon the owner of the parcel of land abutting on the sidewalk. If such sidewalk, curbing or gutter is not cleaned within five days after the service of the notice or completion of the publication, except if the objectionable substance is snow, then within 12 hours after the abatement of a snow storm, the Service Director shall have it done at the expense of the owner. The cost of the cleaning shall constitute a lien upon the property and shall be paid by the owner to the Finance Director. If it is not paid within ten days from the time it was reported to the owner, the Service Director shall certify the cost, together with a penalty of five percent thereon, to the County Auditor who shall collect the same in the same manner as other taxes are collected.
